Purposes and legal bases

We process personal data to receive, allocate and record donations, issue donation receipts on request or where required, deal with questions and fulfil legal obligations.

  • Handling donations and related enquiries: Article 6(1)(b) GDPR insofar as the processing is necessary for the donation relationship; otherwise Article 6(1)(f) GDPR (our legitimate interest in properly allocating and administering donations).
  • Accounting and statutory records: Article 6(1)(c) GDPR.
  • Personal thank-you messages or questions about a donation: Article 6(1)(b) or (f) GDPR, depending on the circumstances.
  • Regular updates about our work or fundraising appeals by email: only where a legal basis exists; for a voluntarily requested email information service, on the basis of your consent under Article 6(1)(a) GDPR. We do not treat making a donation as consent to receive such messages.
  • Publishing your name: only with your explicit agreement (Article 6(1)(a) GDPR).

Personal data we process

Depending on how you donate, this may include your name, postal address and contact details, the amount and date of the donation, the payment reference, payment and accounting details, information needed for a donation receipt and our correspondence. We may also receive payment information from the bank or payment service provider involved.

You can generally make a donation without supplying additional voluntary contact information. However, we need the relevant details, particularly your name and postal address, to issue a personalised donation receipt.

Recipients, service providers and international transfers

Access is limited to authorised people within our association. Where necessary, we share data with banks, payment service providers, those handling our accounts, tax advisers, competent authorities, and contracted IT and communications providers.

Microsoft 365

We use Microsoft 365 for email, file management and collaboration, including Outlook, Teams and OneDrive. According to our documented arrangements, a data processing agreement is in place with Microsoft and the West Europe region is designated for our data. Certain access to or transfers of data to countries outside the European Economic Area, in particular the United States, may nevertheless occur. Where such transfers take place, the applicable transfer mechanism may include an adequacy decision under Article 45 GDPR (such as the EU–US Data Privacy Framework for appropriately certified recipients) or the EU Standard Contractual Clauses under Article 46 GDPR, subject to the relevant requirements. You can request information about the safeguards applicable to a particular transfer using our data protection contact address. For further information, see Microsoft.

Retention

We retain data only as long as necessary for the stated purposes or as required by law. Depending on the type of record, German tax rules generally require certain documents to be kept for six, eight or ten years (Section 147 of the German Fiscal Code, Abgabenordnung); requirements concerning donation receipts under Section 50 of the Income Tax Implementing Regulation (Einkommensteuer-Durchführungsverordnung) must also be observed. We delete contact details sooner where there is no continuing purpose. Legal exceptions or ongoing proceedings may require longer retention in individual cases.

Your rights

Subject to the applicable legal conditions, you have the right of access (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18), data portability (Article 20) and objection (Article 21). You may object to processing based on legitimate interests on grounds relating to your particular situation; you may object to the use of your data for direct marketing at any time.

You may withdraw consent at any time with effect for the future (Article 7(3) GDPR). This does not affect the lawfulness of processing carried out before withdrawal. You may lodge a complaint with a data protection supervisory authority, including the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (Article 77 GDPR).

To exercise your rights, email datenschutz@e4j.org.
